A short guide to the procedural and tax considerations that arise in extrajudicial and judicial settlement of estates under the Rules of Court.
Settlement of estates is governed by Rule 73 et seq. of the Rules of Court and intersects with tax obligations administered by the Bureau of Internal Revenue.
Where the heirs are of age and there is no will and no outstanding debts, extrajudicial settlement remains the most efficient route. Where any of those conditions is not met, judicial settlement is the proper vehicle.
Either way, careful documentation matters. The estate-tax return, the deed of settlement, and the underlying titles must align so that registration with the Registry of Deeds proceeds without delay.
